We have had some follow up correspondence and conversations since then, and we discussed this issue again briefly at the last NGO meeting. Do you have any update on progress addressing any of the issues we raised (lack of subscribers, lack of code promotion, absence of independent review etc.)? I note that the Code now has just 4 subscribers out of 110 members. This is reduction from 2009 when they had 5 out of 106. The list of subscribers is different in two place on the institute website (the subscriber register and the code register list different subscribers). I presume the code register is correct but how could a consumer be sure? None of the subscribers describes or promotes the code on their own sites and only one mentions the code. Some of the subscribers do not have public privacy policies. I can still see no evidence of the 3 year independent review being undertaken, and the Code will be having its 5 year anniversary shortly. Members of the Australian Privacy Foundation would be grateful for a brief update. I have also been asked questions about the Code by other consumer and civil liberty organisations. Do we need to write to you again about this or make a formal complaint? Or will this email suffice? Thanks in advance.
